Terms and Conditions of Rental

This page provides our standard terms and conditions of rental for guests. This website is owned and operated by All Vacation Dreams. The website provides properties managed and marketed for rent through the Company. All correspondence, quotations, bookings and notifications, whether electronic or on paper sent from this site are deemed to be from the Company. This Terms of Use Agreement sets forth the standards of use of the All Vacation Dreams Management Online Service. By using the All Vacation Dreams’ website, you (the “Guest”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at www.allvacationdreams.com website. Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.

Booking
The Company will provide on screen showing the total rental fee to the Guest for the Property. Quotations are under on a first-come, first-served basis. On receipt of the required payment from the Guest, the Company will issue a Rental Agreement by email to the Guest. The competition and sign of Rental Agreement is mandatory within forth-eight hours from the booking.

Acceptance
The Guest agrees that payment of the rental deposit sum to the Company will signify their full acceptance of these rental terms and conditions. The Guest further acknowledges that by payment of the rental booking, the Guest has read and accepted these rental terms and conditions on this web site.

The Guest agrees and acknowledges that the Company will not release the Property or any service prior to receipt by the Company of payment in full. Failure of the Guest to pay rental or for any service will result in removal or refusal to supply said service, including, but not limited to provision of accommodation in the Property. Such removal and or refusal will not alter the terms and penalties associated with cancellation.

The Guest agrees to pay the Total Rental Fee as shown on the Rental Agreement within the due dates as set out on the booking confirmation. Final and full payment is due fourth five days prior to arrival. In the event of late payment, or failure to pay, the Company reserves the right to levy the cancellation penalty percentage charges against any money that the Guest has paid in advance and cancel the booking of the Guest. Where the money paid in advance is insufficient to cover the calculated percentage, the Company reserves the right to exercise any legal remedies to pursue the amount owed by the Guest.

Any changes to existing bookings within fourth two days of arrival will not be permitted. The Company reserves the right to amend rates at any time. Pre-existing reservations, where the Guest has made a payment, will remain at the pre-increase pricing.  Full payment for rental is required no later than fourth five days prior to arrival date. If paying by credit card, your card will be charged now unless other arrangements are made. If payment is not received, your reservation will be canceled, and your deposit will be forfeited. 

Rental Period and Occupancy
The Guest agrees, and the Company permits the Rental Period to begin and end on the dates and times shown as the online Rental Period (as shown on the Rental Agreement.

Check-in
Check-in to the Property is after 4:00/5:00 pm on the date of arrival as shown on the Rental Agreement, Booking Confirmation or Registration Form. At the sole discretion of the Company, any Guest arriving used a Secure PASS code before that time may be refused. Within 24 hours of arrival at the Property, the Guest agrees to complete the Registration Form. Failure to complete the Registration Form will be deemed confirmation that the Guest accepts the Property as found, and accepts responsibility for any and all damages or loss found at the Property on departure of the Guest. Earlier check in times may be available for an additional fee. No refunds will be given for late arrivals, early departures or unused days of your rental property reservation. Pre-arrival required two types of identification.

Check-out
Check-out is at or before 10:00 am on the date of departure as shown on the Rental Agreement and Registration Form. In the event that it is found that the Guest has not departed the Property on the date of departure at the due time, then the Guest will pay a penalty charge of two days rental. A late check-out can only be arranged for an additional fee if the home does not have another guest’s arrival schedule. This option must be arranged in advance and cannot be added on the day of departure.

Basis of rental
Properties offered for short-term rental through the Company are provided on a self-catered basis. The Company provides one soap bar and a roll of toilet tissue in each bathroom, one trash liner and a paper towel as complimentary starter items for each booking party. Once these items are used, it is the guest’s responsibility to replenish them. Except as defined above, items such as trash liners, dish soap and bathrooms tissue are all items that are to be provided by the guest.

Occupancy Limitation
Occupancy is set for two people per bedroom plus an additional two people if there is a sofa sleeper. Guests may not exceed this limit. Only the number of the people mention in the reservation should authorize to stay in the house, regardless of the size of the property’s rented. It may be necessary for staff or agents of All Vacation Dreams to enter, into the premises to perform routine maintenance or repairs. The maximum occupancy excludes children under the age of three years old

Non-smoking
Smoking is not permitted in the Property at any time. In the event that the Guest is found to have smoked in the Property, the Guest will be contacted and informed of any charges related to the cleaning/deodorizing of the Property and all of the items in the Property (i.e. carpets, furniture, window treatments etc.). These charges will be applied to the credit card on file by the Company for the reservation.

Pets
Pets are not permitted in the Property. Guests with pets are advised to place their pet at another facility. The Company cannot be held liable for any loss or injury to a pet while staying at the Property, or for any action taken against the pet or pet owner by third parties. In the event that the Guest brings a pet to the Property, the Company may elect to evict the Guest from the Property with loss of all rental money paid and/or levy a charge of at least $100 per bedroom to the credit card of the Guest, to pay for additional sanitation and cleaning on the departure of the Guest and pet.

Accidental Damage waiver/Property Protection Fee
There is an accidental damage waiver (Property Protection) non-refundable fee added onto all reservations at All Vacation Dreams Homes.
The accidental damage waiver fee is non-refundable
>  The value of the Property Protection Fee is up to $1,000 for Condos and Townhomes
>  The value of the Property Protection Fee is up to $1,500 for Home
The value of the Property Protection Fee will cover reported accidental or inadvertent damage, which must be reported to All Vacation Dreams Homes within 24 hours to be eligible for coverage.
Any damages must be reported to the management company prior to checking out. If you fail to report any damages the insurance will not cover you and you will be charged for the cost of repairs or replacement items.
The value of the Property Protection Fee will become null and void upon Guest departure and any un-reported damage found by All Vacation Dreams Vacation Homes will be at the sole responsibility of the Guest.
The Guest will be fully responsible for all damage charges, which will be processed onto the Guest credit card on file.
In the event that the Guest fails to pay any amount due to All Vacation Dreams Homes for property damages, All Vacation Dreams Homes’ reserves the right to exercise any legal remedies to pursue the amount owed from the Guest.
Intentional damage, theft or gross negligence is not covered and will result in additional costs to the Guest and possible legal action.
This plan is provided by and administrated by All Vacation Dreams and is not an insurance policy.
The Guest agrees that the Company can charge additional fees to cover:
Early arrival or late departure charges
Non-return of keys
> Loss or breakage of inventory items
> Damage to the Property or its equipment
> Unauthorized Pets

Please be advised that intentional damage or gross negligence are the responsibility of the guest and are not covered by this waiver. A credit card/debit cards must be given for all reservations to act as a security deposit. This credit card number will be charged if items are stolen or damaged in the rental property. The property should be left reasonably clean. If the property is not left in a suitable condition, it may be necessary to charge the credit card for costs to cover extra cleaning.

Damage Security Deposit

A security deposit, required and our company will place a authorization hold on your credit card before you check in. The damage security deposit vary of the houses.
A Security deposit is used to cover damage, breakage, and loss to any of the home contents.
The security deposit less any such charges will release within five business days after the Guests’ check out date.  Guests are liable for all damage and loss to the vacation homes during their stay.
Since this it was an authorization only, there will not be a refund to the card.
When you check in at the property, you will need to do a thorough walk through of the home.
If there are any damages, you must contact the local office during business hours. (Mon-Sat 10AM-5PM)
FAILURE TO FOLLOW THIS STEP WILL RESULT IN THOSE DAMAGES BEING CHARGED AGAINST YOU AT THE TIME OF CHECK OUT.
Anything damaged, spoilt or broken will be charged to you at the replacement cost. Any items having to be purchased will be replaced ‘like for like’ to the same quality and standard.
A security deposit may be required from you to cover:
(a) damage or loss to villa contents; and/or
(b) excessive cleaning costs; and/or
(c) excessive electricity use (e.g. air conditioning on full of external doors left open).
(d) exceed the number of guests that the guest mentions at the time of booking regardless of the size of the property.

Cancellation
The Guest may cancel their booking at any time up to or during the Rental Period. In the event that the Guest exercises their right to cancel, the Company will levy the following cancellation penalty percentage rates of the Total Rental Fee:

From initial date of booking up to forty-two days prior to the arrival date full deposit, taxes and fees.
> Between forty-two days to the original arrival date 100% of payments. 
>
20% non-refundable rental deposit at the time to make a reservation.
> 50% if less than sixty days prior to the arrival date.
> 100% if less than forty-two days prior to the arrival date.
> Once a binding contract has been entered into, to cancel the entire booking or any component, the person making the booking must notify us in writing.
> An additional of $150 cancellation fee applied which is automatically charged to the card in the file.
> No refunds will be given for unfavorable weather, early departure, utility service interruption, construction, or maintenance issues and not shows.
Non-Refundable vacation rentals will not receive any refunds in the event of a cancellation.

The guest is reserving a specific property for specific dates. The dates and the property cannot be changed, doing so would effectively be canceling the original reservation, and so the cancellation policy would apply.

If the length of stay is allowed to be reduced from the original dates at All Vacation Dreams’ discretion, the cancellation policy will apply to the nights that have been canceled. The minimum night stay requirement at the time of booking must be met at all times. Rental nights cannot be canceled if they reduce the total number of nights stay below this minimum.

Cancellations of the arrangement due to non-payment of the balance by the due date will result in a loss of all monies. All cancellations must be confirmed in writing.

All Vacation Dreams reserves the right to cancel any reservation made as a result of an error, omission or other unforeseen circumstances. This includes verbal, written or website errors which may affect the price, availability or type of property rented.

All Vacation Dreams advertises rental properties under its own management as well as other local management. This agreement is in effect for any rental property booked through All Vacation Dreams,

If the rental property must be changed due to any circumstances, this agreement will apply to the new rental property.

All descriptions given on the websites are made in good faith and All Vacation Dreams accepts no liability whatsoever for errors or omissions.

Please consider the optional Travel Insurance to protect against unforeseen cancellations.

The Company regrets that it is unable to waive any of the cancellation charges above, whatever the circumstances. The Company recommends consider the optional Travel Insurance to protect against unforeseen cancellations.

Service Level
If you have cause for complaint whilst staying in the villa, this must be brought to the management company’s attention immediately so that action can be taken at the time to rectify the problem. Please contact the onsite management company at the number provided to you on your delivery key document or email us at reservations@allvacationdreams.com
The onsite management company’s office hours are 9am-5 pm Monday through Friday and Sat from 9am to 4pm.
Non-emergency items need to be handled during these hours.
Evenings we are available for emergencies only.
Pool heat is a non-emergency item. Do not call after hours for this item.
There will be a sixty five dollars charge if non-emergency calls are made after hours. Some emergency items would include:
1. No Power or water
2. Locked out of the home
3. Cannot locate the home
4. Any item that may cause damage to the home or to the guest.

No refunds are granted for malfunctioning mechanical or electrical equipment including (but not limited to): inoperable appliances, air-conditioning units, pools and/or spas. No refunds will be given for unfavorable weather, early departure, utility service interruption, construction, or maintenance issues. Additionally, there are no refunds for faulty recording or playback equipment, TVs, audio, telecoms, cable reception, computer equipment or internet access.

Pool & Spa Terms
Pool, spa and hot tub heat is not included as standard with any villa. At the time of booking you will be given the option of paying an additional fee.
Pool heat must be purchased for the duration of your stay
Pool heat will automatically shut off if the temperature drops below 50 degrees Fahrenheit. The onsite property management team cannot override this as it is a security measure to prevent breaking the pool pump.
Refunds will not be given if this occurs. If pool heat is not working correctly, then contact our onsite management staff.
If the pool heater is broken, then pool heat refunds will be given for the number of days the guest is without this service. Staff must be aware of this issue when it occurs.
You shall not be entitled to any other compensation in the event that pool, spa and/or hot tub heating fails.
Refunds will not be given when pool heat issues are brought to our attention after the stay.
Pool heat is set between 83F-89F. We will not be able to adjust the pool heat.
Heated pool services are not customizing.
Pool heaters operate on a timer that are set to come on in the morning and go off in the evening.
Use of the pool is entirely at your own risk. It is particularly important that children are supervised at all times in and around the pool areas. For your children’s’ safety, all villa to pool doors are alarmed. Tampering or disconnection of these devices is a criminal offence.
Pool heat the day of arrival or while you are at the home, there will be an additional fifty dollard call out fee assessed to the guest.
There are no refunds due to the inability of the pool to heat a pool during cold weather. If anyone from the guest’s party, adjust the temperature setting on the pool heater or timer, guest will automatically assume responsibility for any repairs to the pool, pool pump and heater.

Zero Tolerance Policy
Underage Drinking is not allowed and will not be tolerated. If this occurs, we will notify the local authorities and guests will be subject to all local county and/or state laws pertaining to this violation. If underage drinking is discovered in the home, the group will be asked to vacate the property and no refund will be given for the rental.

Limitation of liability
The Company makes all reasonable efforts to provide advice and safety information. This information can be found in the Home-Guide at the Property. It is the responsibility of the Guest to ensure that they have read and understood the contents and advice given following arrival at the Property. The Company is willing to provide any and all further information pertaining to the Property providing the Guest has first read the Home-Guide. In addition, the Company states the following:

> The Company will not release the physical address of the Property until full payment and pre-arrival documents are completed. This is a security measure.

> The Company does not accept liability for equipment failure and or services in the Property. In the event of failure of equipment, the Guest must notify the Company within one working day such that the Company may elect to affect a remedy to the failure. The Company does not accept liability for failure of the pool heater to provide adequate heating where pool heat is provided. Refunds will not be granted when pool heaters fail to operate effectively due to an act of nature.

> The Company does not accept liability for lost or stolen personal property of the Guest from the Property during the Rental Period. The Company provides information and advice in the Home-Pack to the Guest in an advisory capacity only, with no guarantee or promise of security, even where the Guest make use of any advice given by the Company or its representatives. In the event that property of the Guest is lost or stolen, the Guest should advise the appropriate authority first, and then the Company, of the lost or stolen items. The Company cannot responsible for belongings left behind.

> The Company or its representatives may enter the Property at any time, without notice, for the purposes of protection and/or maintenance of the Property. Wherever possible, the Company will provide notice to the Guest prior to such entrance.

> The Company does not accept liability for personal loss or injury to the Guest during the Rental Period. The Guest must ensure that they have adequate insurance cover. The Company provides information and advice in the Home-Pack to the Guest in an advisory capacity only, with no guarantee or promise implied.

> The Guest must ensure that Children are supervised at all times. It is the policy of the Company that all Children under the age of 18 years are not left in rental accommodation un-supervised during the rental period.

> The Company does not accept any liability for the acts or omissions of any agent. These include but are not limited to, airlines, car-hire companies, travel agents, ticket agents, homeowners, or utility providers.

> The Company does not accept liability for acts of violence, nature, fire, flood, war, civil disobedience, riot, or other force majeure that may have a deleterious effect on the Guest.

> The Company does not accept liability for removal of the Property from the marketplace, or transfer of the Property to another company by the Property Owner that results in the Property becoming unavailable for the Rental Period. Wherever such an event occurs, the Company will offer the Guest a suitable alternative accommodation of equal or better quality, subject to availability. In the event Company are not able to offer a suitable accommodation, the Company will refund the Total Rental Fee, less the applicable cancellation penalty percentage rate, taxes and the related processing booking fees.

> Failure to comply with any of the rental terms and conditions herein will, at the sole discretion of the Company, result in the eviction of the Guest from the Property, without recompense or refund.

>  The Rental Agreement between the parties shall be governed and construed in accordance with the laws of Florida. The parties hereto hereby irrevocably submit to the non-exclusive jurisdiction of the federal or state courts in Orange County, Florida. The prevailing party in any litigation shall be entitled to reimbursement of all costs and legal fees incurred in connection with the litigation.

Errors or Omissions
All Vacation Dreams reserves the right to cancel any booking made because of an error, omission or other unforeseen circumstance. This includes verbal, written or website errors which may affect the price, availability or type of unit rented.

Modifications and Interruption to Service
All Vacation Dreams reserves the right to modify or discontinue the Service with or without notice to the Member. All Vacation Dreams shall not be liable to Member or any third party should All Vacation Dreams exercise its right to modify or discontinue the Service. Member acknowledges and accepts that All Vacation Dreams does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.

Third-Party Sites
Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. You should contact the site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party sites is subject to the terms of use and privacy policies of each site, and we are not responsible therein. We encourage all Members to review said privacy policies of third-parties’ sites.

Indemnification
Guest hereby agrees to indemnify and hold All Vacation Dreams harmless for injuries or other losses to Guest and other persons and property that may occur about Guest’s use of the Premises. Guest further agrees that, as agent for the owner of the Premises, All Vacation Dreams has no control over the condition of the Premises and, furthermore, that All Vacation Dreams is not under any obligation to accept for safekeeping any amounts of money, securities, jewelry or other articles of personal property belonging to Guest, nor is All Vacation Dreams liable for any loss in connection with any such items, or for providing security for the Premises. All Vacation Dreams will cooperate in forwarding any complaint or concern of Guest to the owner of the Premises, but shall not be obligated to correct any condition or hazard associated with the Premises.
