Stay Agreement

This Stay Agreement is entered into between you and All Vacation Dreams, effective as of the date your reservation is made. It consists of (i) the Property Terms and Conditions outlined below and (ii) the Terms of Service, Privacy Policy, and any other terms or guidelines posted on our website (www.allvacationdreams.com), provided at the property, or sent to you electronically, as well as any additional booking platform terms (collectively, the “Additional Terms”).

  1. License; Reservation Fees and Deposits

We grant you a limited, non-transferable, revocable license to occupy the reserved property for the confirmed dates and maximum number of occupants. Subletting or transferring rights under this Agreement is strictly prohibited.

At booking, the following fees may apply:

  • Cleaning Fee
  • Property Protection Fee
  • Reservation Processing Fee
  • Resort Fee

A nonrefundable deposit of 25% of the total balance is required to confirm your reservation. The remaining balance is due no later than 42 days prior to arrival. Failure to pay on time may result in cancellation.

Security deposits may be required at our discretion and will be refunded within two weeks following a satisfactory inspection. The Property Protection Fee covers accidental damages only, and any damage must be reported prior to check-out.

  1. Cancellations

All cancellation requests must be sent via email to reservations@allvacationdreams.com.

  • Cancellations 42+ days prior to arrival: deposit retained.
  • Cancellations less than 42 days prior: no refund; full payment due.

We recommend purchasing travel insurance to protect your reservation. Third-party booking platforms may have stricter cancellation policies.

  1. Check-In and Check-Out

Check-in: 4:00 PM | Check-out: 10:00 AM

Final instructions, including directions and door codes, are sent ~ 3 days prior to arrival. For reservations within 30 days of arrival, government-issued ID may be required.

Failure to check out on time may result in double daily rates and additional charges for damages. The credit card on file must match the reservation name. Minimum age to book: 21.

Property inspections occur after check-out. Any excessive wear, damages, or missing items may incur charges as outlined in the Damaged Property section.

  1. House Rules

Guests must comply with all property, community, and amenity rules:

  • Occupants: Maximum limits apply; violations may result in immediate cancellation. Only people mention in the Booking Form are allow to stay.
  • Vehicles: Parking limits enforced; RVs, campers, and trailers prohibited.
  • Pets: Only service animals allowed by law; others incur a $500 fine.
  • Smoking: Prohibited inside and outside; $1,000 fine for violations.
  • Parties/Noise: Unauthorized gatherings prohibited; noise fines apply ($500+).
  • Thermostats: Minimum settings apply.
  • Appliances: Use responsibly; damages are charged.
  • Trash: Dispose of properly; excessive trash may incur fines.
  • Pool Safety: Fences and alarms provided; tampering prohibited.
  • Supplies: Starter toiletries/kitchen supplies provided; additional items are guest responsibility.
  • Rentals/BBQ: Prior approval required; fees apply. Pool heating optional; charges are non-refundable unless system malfunctions.

  1. Compliance with Laws

Guests are responsible for compliance with all laws. Prohibited activities include:

  • Illegal or commercial use without approval
  • Reselling reservations
  • Bringing firearms or hazardous materials
  • Fraudulent, violent, or discriminatory behavior

  1. Safety

You consent to safety features (smoke detectors, pool alarms, fences, etc.) and agree not to tamper with them. All Vacation Dreams may enter the property for emergencies, maintenance, or security. Video monitoring may be used on the exterior in some of the locations. Guests must supervise children around pools and report deficiencies immediately.

  1. Damaged Property

Guests are responsible for property condition and damages caused by themselves or visitors. Notice will be provided for any damage claims, and charges will apply if unresolved. All Vacation Dreams reserves the right to repair, replace, or pursue legal remedies.

  1. Disclaimers; Limitation of Liability

The property is provided “as is.” All Vacation Dreams is not liable for:

  • Mechanical failures (AC, heating, appliances, pools, etc.)
  • External circumstances (construction, outages)
  • Injuries or damages from use of amenities

Liability is limited to the greater of (a) payments made in the last 12 months or (b) $100.

  1. Indemnity

You agree to indemnify All Vacation Dreams and affiliates against claims arising from:

  • Use or misuse of the property
  • Breach of this Agreement
  • Injuries or damages caused by guests or invitees

  1. Dispute Resolution and Arbitration

All disputes will be resolved via binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association. Jury trials or class actions are waived. Arbitration rules are available at www.adr.org.

  1. Governing Law and Jurisdiction

This Agreement is governed by Florida law. Guests submit to the exclusive jurisdiction of Florida state and federal courts.

  1. Attorneys’ Fees

Guests are responsible for legal fees incurred to enforce this Agreement or remove guests from the property.

  1. Modifications

All Vacation Dreams may modify this Agreement at any time; changes are effective upon posting.
